By submitting a job application to the NMI Group of Companies, you acknowledge that you have read, understood, and agree to the following Terms & Conditions governing the recruitment process.
1. Accuracy of Information
You confirm that all information submitted is true, accurate, and complete. Falsification may result in disqualification or termination of employment.
Providing false or misleading information may result in:
- Disqualification from the recruitment process.
- Withdrawal of an employment offer.
- Termination of employment if discovered later.
2. Consent to Processing of Personal Information
By applying, you consent to the Company collecting and processing your personal information for legitimate recruitment purposes, including:
- Screening
- Interviews
- Assessments
- Reference checks
- Qualification verification
- Criminal checks where legally permitted
All processing is conducted in accordance with the POPIA (Act 4 of 2013) or the DPA (Act yet to promulgated), and only authorised personnel may access your personal information.
You acknowledge that providing certain information may be mandatory for the recruitment process to proceed.
3. Recruitment Process Disclaimer
Submitting an application does not guarantee:
- Shortlisting.
- An interview.
- Employment.
The Company reserves full discretion to:
- Reject or accept applications.
- Close job postings without notice.
- Prioritise internal candidates.
- Make appointments based on organisational needs.
Your information will only be used for recruitment and related administrative purposes.
If your application is unsuccessful, the Company may retain your information for a defined period to comply with legal obligations and for future opportunities, in line with POPIA’s retention requirements (Section 14 of the POPIA or section 23 of the DPA).
4. Candidate Conduct
You agree not to:
- Misrepresent your identity or credentials.
- Ask employees to influence the outcome of a recruitment process.
- Harass or pressure Company staff for updates.
- Share confidential interview or assessment material.
- Any breach may result in disqualification.
5. Confidentiality of Recruitment Materials
All interview questions, assessments, scoring sheets, and internal recruitment documents remain the property of the Company.
You may not disclose, reproduce, or distribute this information.
6. Eligibility to Work
You confirm that you meet all legal requirements to work in the respective Country you applying to work in and can provide supporting documents (ID, passport, work permit) when requested.
7. Withdrawal of Applications
You may withdraw your application at any time. Once withdrawn, the application will not be reconsidered for the same role unless explicitly allowed.
8. Record Retention
The Company may retain your application and documentation for a reasonable period for audit, reporting, and future talent consideration purposes.
In accordance with POPIA or the DPA, you may request access to your personal information, request corrections or deletion, or object to certain types of processing. These requests must be submitted to the Company’s Group Compliance Manager
9. Limitation of Liability
The Company is not liable for:
- Technical failures affecting application submissions.
- Delayed or lost communications.
- Decisions made during the recruitment process.
- Damages resulting from reliance on the recruitment process.
- Applications are submitted entirely at the applicant’s risk.
10. Security Measures
The Company implements appropriate technical and organisational security measures to safeguard your information against loss, damage, and unauthorised access, as required under Section 19 of the POPIA or section 27 of the DPA.
11. Amendments
The Company may update these Terms & Conditions at any time. You are encouraged to review them periodically.
12. Third-Party Processing
Some checks may require the Company to share your information with accredited service providers (e.g., background screening companies).
All third-party processors are bound by POPIA or DPA-compliant agreements ensuring lawful and secure processing.
13. Limitation of Liability
The Company is not liable for technical failures, lost communications, or recruitment decisions made in good faith.
14. Amendments
The Company may update these Terms. Continued engagement with the recruitment process signifies acceptance of such changes.
